1) General :
Jims NV, Do Invest NV, Do Invest Lux NV and Jims Expansion NV are jointly responsible for processing personal data collected in Belgium, the Netherlands and the Grand Duchy of Luxembourg (hereinafter "Jims").

The registered office of Do Invest NV is at Edingensesteenweg 196, 1500 Hal, and the company is registered under company number BE 0817.092.663.
The registered office of SA Do Invest Lux is located at 233/241 Rue de Beggen, L-1221 Luxembourg, and the company is registered under company number LU26471630.
The registered office of SA Jims Expansion is located at Edingensesteenweg 196, 1500 Halle, and the company is registered under company number BE0545.977.663.
Personal data is very important to us. We therefore make it a point of honour to protect them as best we can. The use we make of your personal data respects your rights under the law.
Jims processes your personal data in your capacity as a customer when you take out a membership at one of our clubs or online at our website. Jims may also process your data in your capacity as a contact person for a company.
2) What personal data do we collect and how is it collected?
Data that you communicate to us
- Identification and contact data such as first and last name, address, gender, date of birth, photo, e-mail address and telephone number of members and former members.
- Payment details such as bank account number, IBAN code, BIC code, etc.
- Data relating to visiting behaviour (time and duration).
- Training data for members in clubs or via our app or questionnaires.
- Information about your device (e.g. IP address, browser type, etc.) via cookies.
- Job title (for company contacts)
We obtain this personal data in a number of ways:
- by creating a subscription or using our app ;
- through contact forms or questionnaires you fill in, competitions you enter, promotions you use, commercial actions you subscribe to or payment transactions;
- through the company for which you work (for example, when you are designated as the contact person by your employer);
The data collected in the forms is only data that is necessary for the performance of our services.
Via the website and app
We store technical data on each individual visiting our website and our app. This includes, for example, the IP address, the browser, the external website or app that redirected you to us, the time spent on our websites and other statistical information, habits and preferences of the visitor to our websites.
This data is collected by means of cookies, which Jims' websites and app use.
Cookies are small text files placed on the hard disk of the computer and/or devices of visitors to certain websites. They contain certain information, such as the visitor's language preferences. Other cookies collect statistics on visitors to our website or ensure that the website's graphics look good and that the website's applications function correctly.

3) Why and on what basis do we process your personal data?
We need your data to be able to offer you our services. We always process personal data for a specific purpose and on a specific legal basis.
Fulfilment of an obligation
- Provision of goods and services to customers
To enable you to access Jims services and to contact you, we need your identification, contact and payment details. This data enables us to contact you regarding the management of your subscription, to control access to the clubs and to make automatic payments. We also contact you by e-mail about matters relating to your membership; as these are contractual e-mails, you cannot unsubscribe from them.
If you enrol your children in the group lessons dedicated to them, we will store your child's details under your account. By registering your child, you give Jims permission to process this data.
Young people aged between 14 and 18 can create a membership in the club if they have written authorisation from their parents or guardian. The registration form must be signed by a parent or guardian.
- Customer service
When you contact our customer service department, we also keep your details. This includes your customer details, the date and time of the contact, notes taken by Customer Services staff during a telephone call, e-mails you send to Customer Services and details you give us during the call or in the e-mail.
- App
To use the application, you need to log in with your Jim account. Through the app, data such as the sessions booked in your club, the lessons to follow and take and your communication preferences will be processed.
- Competitions and actions
When you enter a promotion or competition, we ask for your name, address, telephone number and email address. This enables us to organise the competition, contact and announce the winner(s) and measure the response to our advertising campaigns.
- Customer and company contact management
We keep the contact details of our customers and business partners for relationship management purposes.
Legitimate interest
- Direct marketing
We will use your contact data to send you newsletters and promotions by post, SMS, push notification via the mobile application or e-mail. This will keep you up to date with our offers, actions and news.
Even if you have cancelled your subscription with JIMS, we may still use your data to send you direct marketing, in accordance with the retention periods as described in point 5.
- Improving our services
We are constantly working to improve our general services and as part of this we also use your personal data. We may also use your data to determine the location of new clubs. In order to better match our services to members' needs, we may also invite you to take part in market research or (satisfaction) surveys.
- Fraud
We use customer data to track, prevent and combat fraud. If necessary, we also pass on customer data to the competent (administrative) authorities, judicial bodies or other public bodies.
- Management and improvement of the website and app
We also use the data of visitors to our websites and app to manage and improve these sites and app and to analyse their use. To do this, we also use third parties such as network providers, website and app designers, online marketing specialists and consultants.
Authorisation
When you create your subscription and in our app, you can choose to add a photo to your profile. We process this photo with your permission.
As part of certain subscription packages, we personalise our services, for example by customising training programmes based on your personal information. As a result, we sometimes process data relating to your health. We only do this with your express permission.
4) Who has access to your personal data?
Jims employees
Jims employees have access to your personal data insofar as they need it to carry out their duties and tasks. In any event, your personal data will only be processed for the purposes described in point 3.
Jims staff are bound by strict internal rules and procedures regarding the processing of personal data. They are also required to comply with the technical and organisational measures we have taken to protect your personal data.
Partners and service providers
Jims may use the services of third parties for operational purposes. These include suppliers who manage online payments, an external company in charge of sending our direct marketing, companies who carry out market research for us, etc. These third parties are bound by this Privacy Statement and may not use your personal data for purposes other than those described in this Statement.
When you use the Jims app, the manager of our app also has access to your personal data. When you use the app, its Privacy Statement also applies. It is available here.
Other service providers also need access to your personal data. These include law firms, debt collection agencies, bailiffs, insurance companies and banks.
Competent authorities
In addition, we must transmit your personal data to the competent authorities when their request is legitimate. We will check and examine any such request before actually passing on your data to the competent authorities.
5) Where do we store your personal data?
We store your data within the European Union.
Some of our service providers process or store your personal data outside the European Economic Area. For the transfer of personal data to third countries outside the EEA, we will take appropriate measures to ensure that this transfer is carried out in accordance with the rules applicable to the international transfer of personal data. You can obtain further information on these measures and receive a copy by exercising your rights as described in point 8.
6) How long do you keep your personal data?
Your personal data is kept for as long as is necessary to achieve the purpose for which it was collected. We keep your data for a maximum of 5 years after the end of our contractual relationship. We may continue to send you direct marketing messages for up to one year after your subscription has ended.
However, you can always request that your personal data be deleted earlier, as described in point 8.
When you use our app, our service provider is also responsible for certain data. Their retention periods are set out in their Privacy Statement.
7) How do we secure your personal data?
We take the necessary administrative, technical and organisational measures to guarantee the security and confidentiality of your personal data. We protect your personal data against destruction, loss, misuse and unauthorised access, which may result in physical, material or immaterial damage.
We store your personal data on well-secured and controlled computers. When we collaborate with other parties, we require the same level of security from them. However, despite our best efforts, we can never fully guarantee the security and protection of your personal data.
8) What are your rights?
Jims attaches enormous importance to the protection of your personal data. Our use of your personal data respects your rights under the law. This is why we have summarised them all below. You can contact us using the contact details at the end of this Privacy Statement.
You can request an overview of the personal data we hold about you. You can have incorrect data corrected and data that is no longer relevant deleted.
You may object at any time to the use of your personal data for direct marketing purposes by e-mail by clicking on the unsubscribe link at the bottom of each e-mail. For direct marketing by SMS, you can send STOP SMS in response to the SMS sent. If you no longer wish to receive paper mailings, you can send an e-mail to our Customer Service department at support@jims.be or write to Jims - Customer Service - Edingensesteenweg 196, 1500 Hal.
You can also set your communication preferences at any time via our Jims app via "studio" > "Self-service" > "communication".
You may also defend other processing operations that are in your legitimate interest.
If you have given your consent to the processing of your personal data, you may withdraw it at any time, but you should be aware that in this case you will not be able to take full advantage of all the services. In this case, we will anonymise the data collected with your authorisation.
You can send your request for deletion to Jims at any time. If your data is no longer required for legitimate processing, it will be deleted, otherwise you will be informed.
You may request that the data we have obtained from you under the agreement be transferred to another party.

If you have a complaint about the way we process your personal data, you can contact our Data Protection Officer (DPO) at dpo@jims.be or on +32 (0)9 396 11 81.
If he cannot provide you with sufficient assistance, you can always contact the competent authorities and lodge a complaint.
- For customers in Belgium, this is the Belgian Data Protection Authority.
- For customers in the Grand Duchy of Luxembourg, this is the Commission Nationale pour la Protection des données (CNPD).
- For customers in the Netherlands, it is the Autoriteit Persoonsgegevens (AP).
10) Changes to the Privacy Statement
We are constantly developing and improving our services so that we can continue to offer you the best possible service at all times. For this reason, we will regularly adapt this Privacy Statement so that it always correctly sets out how we process your personal data. Although we make every effort to notify you of any changes, we still recommend that you consult our Privacy Statement regularly. It is your responsibility to keep abreast of any changes.
